1. Parties and Agreement
These Terms and Conditions govern the agreement between ORANGE VINYL STUDIOS ("Service Provider") and the Bride and Groom (the "Clients"). By accepting these terms and paying the required deposit, the Clients agree to the terms outlined herein. These terms constitute the entire understanding of the requirements, schedule, and payment terms for the wedding services listed in the accompanying quotation.
Any disputes arising from these terms shall be resolved in accordance with the laws of Gauteng, South Africa.
2. Payment Terms
- A deposit equal to 50% of the total fee is required to secure the booking. No reservation will be made without the signed acceptance of these terms and deposit.
- The remaining balance must be paid in full no later than two (2) days before the scheduled wedding date.
- Failure to pay the remaining balance by the deadline will result in termination of the agreement, forfeiture of the deposit, and release of the Service Provider from any obligations.
3. Cancellation Policy
- Cancellations made at least ninety (90) days before the wedding date will result in a refund of 50% of the deposit.
- Cancellations made less than ninety (90) days before the wedding date will result in forfeiture of the entire deposit.
- Written notice of cancellation must be provided via email or certified mail.
- If the Clients have made the final payment and subsequently cancel, they will be refunded the total amount paid minus the deposit. No refunds will be issued after the wedding shoot is completed.
4. Rescheduling
- Rescheduling must be requested at least thirty (30) days before the wedding date and requires written approval from the Service Provider.
- If the Service Provider is unable to accommodate the new date, the Clients will forfeit 25% of their deposit but will not be held liable for the remaining balance.
5. Liability
- If the Service Provider is unable to deliver the agreed services due to unforeseen circumstances, the Clients will receive a full refund of all payments made.
- The Service Provider’s liability is limited to the amount paid by the Clients and excludes the deposit.
- The Service Provider is not responsible for loss or damage to footage or photographs after delivery.
6. Digital Media
- The Service Provider does not maintain archives of images or footage beyond thirty (30) days after the final invoice date.
- The Clients are responsible for requesting any additional files within this time frame.
7. Pricing
- Any additional services or products not listed in these terms will be charged at current rates.
- The Service Provider reserves the right to change prices for additional services but will notify the Clients beforehand.
8. Responsibilities
- The Service Provider will be the exclusive videographer and photographer for the event.
- Clients must prevent other individuals, including guests, from interfering with the Service Provider’s duties.
- The Service Provider is not liable for compromised coverage due to interference, late arrivals, poor lighting, or unsuitable backdrops.
- The Clients must confirm the event details (date, time, and location) no later than seven (7) days before the wedding date.
9. Harassment
- The Clients are responsible for ensuring appropriate behavior by all guests, vendors, and wedding party members.
- The Service Provider reserves the right to cease services and retain all fees if subjected to inappropriate, threatening, or hostile behavior.
- The Service Provider will notify the Clients of such behavior, allowing them the opportunity to address the issue before work is stopped.
10. Coverage and Additional Services
- Coverage includes the services outlined in the accompanying quotation for the agreed duration and venues.
- Additional coverage requested on the day of the event will incur additional charges at the agreed hourly rate.
- The Service Provider will strive to provide satisfactory coverage but cannot guarantee specific images, poses, or footage.
11. Image Processing and Delivery
- Color correction and retouching are included in the service.
- Additional copies of media must be requested within thirty (30) days after the wedding date. Delays may occur if requests are made after this period.
- The Service Provider archives media after thirty (30) days to protect it but cannot guarantee integrity beyond this period due to unforeseen circumstances.
12. Model Release
- The Clients grant the Service Provider unrestricted rights to use images and footage for advertising, portfolios, workshops, education, and award submissions.
- Clients may request in writing to limit specific uses of the media.
- The Service Provider will not sell the media to third parties without the Clients' consent.
13. Copyright and Reproduction
- All photographs and footage remain the intellectual property of the Service Provider under South African Copyright Laws.
- Clients may not reproduce or modify the media without written consent from the Service Provider.
- Unauthorized reproduction will result in a financial penalty of R500 per violation.
- Clients may share media on social platforms and with others but may not sell it to third parties without approval.
14. Approval and Amendments
- These terms represent the entire understanding between the Clients and the Service Provider.
- Any amendments must be made in writing and signed by both parties.
By accepting these terms, the Clients acknowledge that they have read, understood, and agree to abide by them.
